Midway Games have been misbehaving and I'm more than a little irritated about it. Here's what's up ...
As any regular readers here will know Twitch is on very friendly terms with the lads who run the New York Asian Film Festival. I consider Grady Hendrix a personal friend and one of the other Subway Cinema lads, Goran, is an occassional writer for us here. The NYAFF is not a large organization, not by any means. What they are is a small group of dedicated film lovers who, every year, absorb significant personal losses to put on a festival that brings in the best Asian films from around the globe. We're talking about people who have literally staked a significant amount of their own, personal financial security on the festival all with the aim of simply exposing a few more people to some more of the good stuff.
So, this year, when Midway Games agreed to come on as a title sponsor for the NYAFF it was news greeted with a great deal of excitement. It meant no more personal risks and an expanded budget that would allow them to bring in more high profile films and guests. And they'd get to help launch Stranglehold, the video game quasi-sequel to Hard Boiled helmed by John Woo which Midway is currently poised to roll out. It seemed a good fit for both sides and the NYAFF started making plans, making commitments and signing contracts based on their agreement with Midway.
The NYAFF have made good on their end of things. Press releases went out announcing the deal with both Midway and Stranglehold getting prominent play in every press release the group has sent out. Lots of exposure for the product makes sponsors happy, after all. Everything seemed good until the Midway people simply failed to show up at a meeting to install game consoles in the theatre lobby so festival patrons could try things out. No call, no cancellation, no indication anything was amiss. Nothing. The NYAFF had no signs anything was wrong until they called Midway up to see why they'd missed the meeting and were told unceremoniously that Midway was ditching the deal, no explanation given.
So, here's how it looks from here. Midway - a company that can surely afford to pay for its own advertising - entered into a deal with the NYAFF and exploited that deal for free publicity before bailing on their financial obligations. The NYAFF, for their part, are now stuck holding the bag on all of those obligations, plans having already been made and agreements entered into all predicated on the financial deal with Midway. These guys are going to lose thousands of dollars of their own money because Midway just couldn't be bothered to fulfill their obligations. And with this sort of organization that sort of loss isn't some abstract number on a bottom line, it's someone's rent money. Not cool. Not cool at all.
The NYAFF are handling this with far more class and grace than I would be able to in their situation. They're not asking for a boycott. But I am. Midway have exploited them for their own financial gain and should not be allowed to profit from their poor behavior. So ... I'm asking you to not play their game. Don't buy it. Don't rent it. When Stranglehold releases, simply ignore it. And encourage your friends to do likewise.

Subway Cinema never thought that the people who invented Ms. Pac-Man would kick us to the curb, but a mere four weeks before the start of the New York Asian Film Festival (June 22 July 8), Midway Games, who had been working with us as the festival¹s presenting sponsor, have pulled out of the festival entirely.
How did we find this out? One of our members was meeting a team from Midway at the IFC Center so they could measure the lobby for the installation of the video game consoles that would launch their new game at our festival. They never showed up, and they never called. When we finally tracked them down by phone in Chicago they curtly informed us that they were not giving us the sponsorship money, the decision was out of their hands and offered little in the way of further explanation.
The damage has been devastating. We had been working on press releases with their publicity department, organizing parties to their specifications and promoting their game with our good name. We had expanded the festival, paid higher fees for movies, brought in out-of-town guests, and were planning a number of events to be paid for with the money we had been told was coming from Midway. Now we don¹t even have a quarter left in the bank to soothe our woes with a game of Tron.
But we will not let this festival die.
Already, we¹ve been overwhelmed by offers of support from companies like ImaginAsian, Fortissimo and Magnolia who have stepped in and asked what they can do to help. Our members are further alienating their loved ones by digging deep into their own pockets to cover the costs of the festival. We¹re currently in the process of restructuring the fest and will announce some changes as well as our full line-up and schedule on Monday, June 4.
We want everyone to know that Midway Games and ³John Woo presents Stranglehold² are no longer associated with the New York Asian Film Festival in any way, shape or form.
But don¹t weep for us. The festival is still happening because the New York Asian Film Festival is like a zombie bunny made of love. It is unstoppable, it is super-cute, it is coming for your brains and it will always believe in
the healing powers of the weird, wild whirlwind of fun that is Asian cinema.
But we will never look at Ms. Pac-Man in quite the same way again.
I like Midway games and this doesn't seem to be such a big reason to boycot them, really. From what I've read something fishy was in the deal, maybe, so Midway just decided to walk away from it. The festival organisers should have had better policy.
Something fishy in the deal? Like what, exactly? And where did you read this?
Here's what happened: Midway agreed to pay a sizable amount of money to become the title sponsors of the festival. NYAFF accepted their offer and terms and proceeded according to the deal, labelling Midway the title sponsor in every press release, in the print materials they were preparing, in absolutely every festival material released so far. I know because I get all of their festival stuff and Midway was everywhere in it. NYAFF was prepping their theaters to house game concoles so festival customers could try out Stranglehold at the festival, as per the agreement, when Midway simply bailed.
They didn't call, they offered no explanation, they offered no apology. They didn't have the basic courtesy to even tell NYAFF that they wanted out of the deal, they just didn't bother to show up one day. That's incredibly low class.
NYAFF did everything you're supposed to do for a sponsor - absolutely everything - and Midway just pissed off for no reason, with no warning, and left them with a budget shortfall in the tens of thousands of dollars with less than a month to go before the festival launch. The festival's policy and behavior were perfectly fine, the only mistake they made was trusting Midway who have turned out to be completely untrustworthy.
Wow, that sucks. I would join the Boycot but I don't buy MIdway games anyway, I havne't enjoyed one since Pacman...

Midway sucks anyway. There doesn't even need to be a boycott because everyone already doesn't buy their games, haha. That's why they did this, they don't make much money.
When were these guys gonna get paid by Midway? I admit to not knowing anything about this business crap but it seems naive to make investments in the tens of thousands of dollars without having been paid by your sponsor in advance.
That's pretty weak sauce on Midway's part. Shame too, the game looked alright.
Gezz, I feel really bad for the guys at NYAFF. Couldn't they get Midway to legally compensate their losses for breach of contract?

I'm gonna buy the game because I like video games.
I like Twitch too, but unfortunately I don't see the direct relation of a game created by nerds locked away in a lab for 40+ hour nights, the bad decisions of the publisher/ad firm, and my wallet.

Caterpillar: basically the way these things tend to work, and the way it worked here, is that you aim to lock up a title sponsor at least six months to a year before the event. This allows you to budget and plan. Money generally comes in installments, the first block coming in after the sponsor can see that you're filling your end of the obligation and the rest coming - hopefully - before all your post-event bills are due. That was the arrangement here. The first half of the sponsorship money was due to be paid right when Midway bailed.
What a low blow! You can bet these assholes will NOT get any of my $$$ . I hope the word gets spread around so people will know what an irresponsible ridiculous rotten company they are . I am a huge video game fan, but will no longer support Midway! Tbank you for the story on this!

Don't know if any of their readers really cares about it, but the word is getting out there at least.
This is what contracts are for and that's why there won't be any legal action. Something fishy was going on and the facts don't add up.
By the way Twitch spelled 'boycott' wrong in the headline.
There will be legal action, actually, they're just more concerned with getting the festival up and running right now than they are with sitting around in a lawyer's office. Festival opens in under a month and they've got to get new sponsors lined up, film prints in, guests in etc in that time. Once the festival's done there absolutely will be legal action taken.
